Interpolating amounts from DEXSW 50864 for Regular Officers in Home made tables

Having finished with the feverish activity of scanning and posting the hundreds of pages of tables provided in reply to DEXSW 50864, and in the absence of any expert comments, I decided to look at what I had (with the help of Brig Vijay Raheja retd and an Excel expert) compiled.

I found that the same notional pay has been indicated over several rows in columns under 5, 6 and 7 CPC. Is it, I wondered because of bunching?

And then, though CGDA and its Principal controllers had indicated that Col and Brig (and equivalents) had been paid Rs 81700 and Rs 81900 as pay as on 31.12.2015, they never reached the top of the Pay Matrix of their respective Levels (13 and 13A). That was intriguing.

Then the indices in the Pay Matrices for the higher ranks appear not have been reached even though Lt Gen HAG+ reached and were paid Rs 80000 as pay as on 31.12.2015.

In the attached tables

Column 2 indicates total amount due in 4 CPC viz. Basic Pay in the integrated scale plus Rank Pay where applicable. In column 3 is Pension at 50% of that amount.

Column 4 indicates the same as above for 5 CPC pay scales.

Column 7 indicates the total of Pay in the Pay Band + GP + MSP as applicable.

Column 8 indicates the pension in 6 CPC based on the above.

Column 11 and 12 indicate Ord Pension (50%) and Fam Pension (30%) of the total of Pay in the Matrix plus MSP where applicable.

Attempts will be made for similar comparison as a self study for AMC/ADC/RVC, MNS and PBOR.

Please advise how much is the Classification allowance for JCOs and what is the Gp X pay in 6 and 7 CPC,

Notional Pay Fixation Formulae

For a more informed reading of the draft Concordance tables, one needs to see and understand the following: -

(a) PCDA Circular No. 585

(b) The original PPO at the time of retirement which gives you your pension.

2. If you retired on or before Third CPC (1973) or up to 1.1.1985, you were paid a Standard Rate of Pension dependent on the Rank. It did not vary with years of service as long as you served the minimum qualifying service (QS) for each rank.

3. Your 3rd CPC pay was revised for 4th CPC as follows: -

(a) Basic Pay i n existing scale + (b) Dearness Pay + (c) Additional DA + (d) Adhoc DA at index of 608 + (e) Instalment I and II of Interim Relief.

4. Your 4th CPC Pay was revised for 5 CPC as follows:

(a) Fitment factor of 40% of 3 CPC Pay with at least one increment in the revised scale for 3 increments in the pre-revised scale.

5. Your 5th CPC Pay was revised for 6 CPC as follows:

(a) Existing 5th CPC Pay multiplied by a factor of 1.86 rounded off the the next multiple of Rs 10; total of Pay in Pay Band (PIPB) will be revised Basic Pay w.e.f. 1.1.2006

Notional Pay based pension vis-a-vis OROP

I am providing information obtained through RTI from the concerned Public Authority, which is DESW of MoD in this case of Notional Pay based draft Concordance Tables for all ranks.

The manner in which the Notional Pay based pension would impact OROP is for many experts who have expressed their opinions on their blogs/twitter/other social media.

As I understand, Notional Pay is based on the reckonable emoluments one was drawing at the time of retirement or death for family pensioners. It was Basic Pay (later Pay in the Pay Band), Rank Pay (later Military Service Pay) plus Grade Pay (6th CPC), and where applicable NPA, Classification Allowance and Group X Pay (6th CPC).

6th CPC also introduced Modified Assured Career Progression for PBOR which is one Grade Pay and one rank higher with associated PIPB in year 8 (Sepoy to Naik), 16 (Naik to Havildar) and 24 (Havildar to N/Sub) of service.

In the 7th CPC it is Basic Pay plus MSP + where applicable NPA, Classification Allowance + Gp X Pay.

Notional Pay at time of retirement/death would mean, in my understanding, that Pay would vary for the same number of years of total qualifying service and same rank, if every one in that particular rank superannuated at the same age. The reason will be some one who would have been promoted earlier than others (even in the calendar year as there were two time periods for increments in Jan and Jul till 31.12.2015), thereby earning more number of increments, whereas those promoted later would earn lesser number of increments. Therefore, there will not be an uniform pension for same rank & qualifying years of total service.

The principle of OROP of Same Rank, Same Years, Uniform amount of Pension was tinkered with calculate the average of 50% of the maximum and minimum reckonable emoluments with protection for higher emoluments (and pension) and raising the pensions lower than the average.

So, there may be pensioners drawing more pension than given in the OROP tables (Circular 555) because of the ibid protection.

Further, in a recent Supreme Court order (Civil Appeal No. 10005 of 2010, order dated 11 Jul 2018), PBOR of the Submarine arm who retired in the 3rd CPC dispensation are entitled to have Submarine Pay included in the Reckonable Emoluments.

It is anticipated that, quoting Nakara and Vains that there cannot be a cut off date, PBOR (and may be Officers) of the Submarine Arm will seek judicial remedy. Seeking legal remedy may also be exercised by personnel of Army Aviation, Naval Aviation and Flying Branch of Air Force.

DEXSW 50864 Draft Govt Letter - Please read before discussing whether OROP or this is better

The amounts given in the attached Draft Concordance tables is Basic Pay.

Our pensions are based on 50% of Reckonable emoluments i.e. Basic Pay + Military Service Pay + NPA where applicable, Classification Allowance, Group X Pay where applicable.

So, before debating the Notional Pay vs OROP please add the amounts and then take 50% of the new amount as your Pension under 7 CPC dispensation.
