Sir,
Please refer to the reply of honourable MoS, Defence to Lok Sabha Starred QuesAon No. 122 by Dr Shashi Tharoor, honourable MP, on the status of the One Man Judicial Committee (OMJC).

2. The honourable MoS in MoD stated that an Internal Committee has been constituted to examine the recommendations of the OMJC.

3. In this connection, please provide the following information:

3.1. File notings leading to the decision to refer the recommendations of OMJC to an Internal Committee

3.2. Date on which the Internal Committee was constituted.

3.3. Date on which the OMJC Report was sent/handed over to the Internal Committee

3.4. Names of the officials and their designations and their status on the Internal Committee viz.

2.       In this connection, please find enclosed a copy of noting extracts from File No. 1(7)/2016/D (Pen/Pol) vide which the Hon’ble RM approved the constitution of the said Internal Committee as well as copy of MoD order bearing No. 1 (7)/2016/D (Pen/Pol) dated 19.07.2017 which is self-explanatory.

          A meeting was held on 11.7.2017 under the chairmanship of Hon’ble Raksha Mantri to review the status of OROP payment and One Man Judicial Committee (OMJC) report submitted to the Government.

2.       The meeting was attended by Secretary (ESW), FA (DS), CGDA, JS (ESW) and JS & Addl FA (RK). After the review, Hon’ble RM has directed that an internal committee be formed to examine the recommendations of OMJC with respect to feasibility and financial aspects. Accordingly, it is proposed to constitute a Committee as under:

       JS (ESW)                         : Chairman
      JS & Addl FA (RK)             : Member
      Jt CGDA (Pension)             : Member

3.       The terms of reference of the Committee would be as under:

          (i)      To examine and analyse the recommendations of OMJC

(ii)      To examine the feasibility of implementation of 
recommendations

(iii)     To work out financial implications.

4.       The committee may submit its report within 2 months (emphasis supplied by Aerial view). Secretary (ESW) may like to approve the above.

ORDER

A meeting was held on 11.07.2017 under the Chairmanship of Hon’ble Raksha Mantri to review the status of One Rank One Pension (OROP) payment and report submitted by One Member Judicial Committee (OMJC) to the Government wherein it was directed that an Internal Committee be formed to examine the recommendations of OMJC with respect to feasibility and financial aspects. 

          Accordingly, with the approval of competent authority, an Internal Committee has been constituted to examine the recommendations of OMJC with respect to feasibility and financial aspects. The constitution of Committee is as under:

          Shri Ravi Kant, Joint Secretary (ESW)           : Chairman

          Shri R K Karna, JS & Addl FA (RK)                  : Member

          Shri Kanwaldeep Singh, Jt CGDA (Pension)     : Member

2.       The terms of reference of the Committee is as under:

  2. The terms of engagement for HFO is mentioned 32 yrs.in stead of 33 yrs. HCO is awarded only on attainig the age of superannuation.This the only rank on awarded on superannuation age in armed forces. The app. X of PCDA cir. 501 is prepared without knowing Air Force Policy by PCDA ALLAHABAD.
    I am retired on superannuation after completion of 38 yrs.19 days.
    The pension to be fixed by reducing to 33 yrs.This is the minimum knowledge concern person should know it.
    This has no concern with OROP.when I applied to remove the anamoly.
    I received the reply that OMJC is Under concideration,when rule is already existing why it is related to OMJC. The same PCDA who issued the circular refuse to amend this as it is policy matter. This shows that the OMJC is being used as cutting tool to nagate the anamolies.

  3. The committee was given two months time to study OMJC report, as emphasised by the writer (AIR MSHL). I do not know how many years (R) years form the so-called TWO MONTHs. I think I should enrol myself in a primary school to learn months, days years. By the way I will feel obliged if some one guides me as to how many years form Two months.

  4. Sir,Good effort in finding out the abnormal delay in implementation of OMJC recommendations. I am sure you would be filing further RTIs to dig out more facts which are not in public domain.

  5. Need to file another RTI , asking progress & outcome & reason for delay.Name & rank of the responsible office for negligence and delay.
