Why the O/o CGDA Opined Colonels and Brigadiers & equivalents will not get more pay/pensions than General officers



Greetings on the occasion of Army Day 2018

CGDA Calculations Pay of Colonel and Brigadier and equivalents (non AMC/ADC/RVC)

On MoD F No. 1 (43)/2008/D (P/S), while vetting the draft Special Army Instruction No. 2/S/2008, Director (IC), Deptt of Expenditure, MoF has observed at Note 10, inter alia, that MoD may take a view whether in Para 10 (b), the maximum reached in PB-4 needs to include MSP as well, otherwise at the maximum of the Pay Band in future Colonels and Brigadiers would draw more pay/pension than Lt Generals and Army Commanders i.e. a pay of Rs 67000 plus 8700 plus 6000 equal to Rs 81700 in case of Colonels and Rs 81900 in case of Brigadiers.



2.        However Dy CGDA (AT) vide UO No. AT/1/1496-II dated 20.10.2008 has dismissed such a possibility stating, inter alia, that in all probability they are likely to be promoted to higher rank or retire on attaining the age of superannuation.



3.        In replies to CGDFA/R/2017/50280, various Pay and Pension authorities such as PCDA (O), Pune vide LW/SS/AT/RTI/45/Vol-V dated 29.8.2017, PCDA (N) vide AN/I/LC/RTI/Corr/Vol-XXIV dated 25.09.2017, and AFCAO vide Air HQ/23401/204/4/12206/E/PS dated 20.09.2017 have confirmed that several hundred non-AMC/ADC/RVC officers are indeed drawing more pay and pension as on 31.12.2015 compared to Lt Gens and Army Commanders.



4.        Please provide information as defined in Section 2(f) of the RTI Act, 2005 including file notings, the tabulations and calculations that enabled the Dy CGDA arrive at the conclusion communicated to MoD in the above mentioned UO No. AT/I/1496-II dated 20.10.2008.

            The points raised at para (d) and € of Note 3 ante have been examined and the following comments are furnished.



            Para (d):        The pay fixation tables in respect of MNS Officers of the ranks of Colonel, Brigadier and Maj General have been prepared based on the formula given by the Govt and are placed below as annexure I, II, and III respectively.



            It is stated that MNS officers of the rank of Colonel drawing pre-revised pay of Rs 15800/- and Rs 16100/- including two/three stagnation increment(s) in the pre-revised scale of Rs 13400-300-15500 would get fixed at Rs 42120/- whereas Colonels of regular Army drawing Rs 17100/- (including Rank Pay of Rs 2000/-) have been fixed at Rs 40890/-. Further MNS Officers drawing Rs 16400/- including three stagnation increments would get fixed at Rs 43390/- whereas Colonels of the regular Army drawing Rs 17100/-, Rs 17550/- and Rs 18000/- are getting fixed at stages less than Rs 43390/-. Similarly MNS Brigadiers drawing Rs 15900/- in scale of Rs 14700-300-16200 would get fixed at Rs 42120/- whereas Colonel drawing Rs 17100/- have been fixed at Rs 40890/-. The table enclosed at annexure IV will illustrate issue further.   



            The pay fixation table in respect of Lt of MNS (Local) prepared as per formula given by Government is given at annexure V. It will be seen that Lt of MNS (Local) drawing Rs 8300/- in the pre-revised scale of Rs 5500-175-9000 would get fixed at Rs 18900/- whereas Lt of regular Army have been fixed at Rs 15600/-. Pay fixation tables given as annexure – V would highlight this anomaly.



            It can be seen that the anomaly cannot be resolved within the ambit of existing instructions, and necessary policy decision will need to be taken by MoD/Min of Fin.



            Para (e): -     It is seen that a Colonel drawing three stagnation increments after reaching the maximum of the pre-revised scale as on 01.01.2006 would cross Rs 80000/- after drawing 11 increments in the revised scale. Similarly Brigadier drawing three stagnation increments after reaching maximum of the pre-revised scale as on 01.01.2006 would cross Rs 80000/- after drawing 10 increments in the revised scales. It is very unlikely that officers of the rank of Colonel and Brigadier would have such long residency periods in the respective ranks. In all probability they are likely to be promoted to higher ranks or retire on attaining the age of superannuation.

            Subject:         Implementation of VI CPC Recommendations – Acting Rank etc



            Placed below is file No. 1 (51)/2008-D (Pay/Services) received from Director (AG) Min of Defence seeking comments of this HQ office on the following issues as contained in Para (d) and (e) of Note 3 of the file.



            (i)        MNS Officers drawing more pay than Colonels and Brigadiers



(ii)       Colonels/Brigadiers at maximum of PB-4 drawing more pay/pension than General Officers



            Points mentioned above have been examined and it is submitted that MNS officers of the rank of Colonel drawing pre-revised pay of Rs 15800/- and Rs 16100/- including one/two stagnation increments in the pre-revised scale of Rs 13400-300-15500/- would get their pay fixed at Rs 42120/- and Colonels of regular Army drawing Rs 17100/- (including rank pay of Rs 2000/-) have been fixed at Rs 40890/-. A detailed illustration of the anomaly arisen in this case has been shown in Annexure –IV placed below. This has been (sic)  occurred due to fixation of Col of MNS and regular Army in the pay band of PB-4. Similar type of anomaly will also arise in case of Lt of MNS (Local) where Lt of MNS (Local) drawing Rs 8300/- in the pre-revised scale of Rs 5500-175-9000 would get his pay fixed at Rs 19800/- whereas Lt of regular Army have been fixed at Rs 15600/-. Pay fixation table is placed opposite as annexure – V.



            (Emoluments of Colonels and Brigadiers) with increments after reaching maximum of the pre-revised scale as on 1.1.2006 would cross Rs 80000/- after drawing 11 ad 10 increments respectively. It is, however, very unlikely that officers of the rank of Colonel and Brigadier would have such long residency period in the respective ranks, as they are likely to be promoted to the higher ranks or retire on attaining the age of superannuation. Tables showing emoluments drawn after allowing increments @ 3% up to Rs 80000/- in respect of Colonel and Brigadier are placed opposite as Annexure VI and Annexure VII.



            In view of the above, if agreed to we may apprise MoD accordingly. Draft UO Note to MoD is placed opposite for approval please.

Notes by Aerial View using 20:20 hindsight: -



1.        Due to the time frame of AVSC in 2005 (w.e.f 16 Dec 2004) as on 1.1.2006, the promotion for Select rank of Col was at 16 years of service (age 37 if commissioned at 21 years of age). Hence possibility of Colonel achieving Rs 67000 + 8700 + 6000 = Rs 81700 is earlier than predicted by CGDA.



2.        The time frame for promotion to Select ranks was further reduced by the Command Exit policy of 2009, so possibility of Colonel achieving Rs 67000 + 8700 + 6000 = Rs 81700/- and Brigadier achieving Rs 67000+8900+6000 = Rs 81900/- is earlier than predicted by CGDA
