            Scope defined in the meeting held on 26.2.2014 chaired by Hon’ble RM (MoD ID dated 26.2.2014)



            “One Rank One Pension (OROP) implies that uniform pension be paid to the Armed Forces personnel retiring in the same rank with the same length of service irrespective of the date of their retirement and any future enhancement in the rates of pension to be automatically passed on to the past pensioners.



            This implies bridging the gap between the rates of pension of the current pensioners and the past pensioners and also future enhancements in the rate of pension to be automatically passed on to the past pensioners.”

    • After initial upgradation, pension will be revised on 1st July every year starting from 1st July 2014 [Para 9 (a)]



    • If revised pension for a rank at any length of service is less than the pension for the same rank for lower length of service, pension of higher length of service shall be stepped up to the level of lower length of service for that rank [Para 9 (f)]



    • If live data is not available for any rank/length of service, pension for the next higher rank for same length of service to be taken reducing the pension by half the amount of difference in Grade pays of the two ranks [Para 9 (k)]

  • Beyond the scope of OROP



    • Honorary Nb Sub, MACP Nb Sub & equivalents will be granted the pension of Nb Sub [Para 9 (j)]



    • Change/improvements in Hony Lt/Capt shall be applicable to regular commissioned officers in the ranks of Lieutenant & Captain, if it is beneficial [Para 9 (j)]



    • Condition for counting of reduced service in the ranks for pre-1986 retiree officers shall be removed in order to pay all retirees with the same criteria [Para 9 (m)]

  • Beyond the scope of OROP



    • Pension of current pensioners for all time bound ranks (up to Colonel) to be extended to past pensioners with same length of commissioned service, if the past pensioners had retired before 16th December 2004



    • For this purpose, years of service will be relevant and tables for higher rank shall be taken into consideration to determine pension [Para 9 (n)]



    • Any changes in the policy regarding pay or promotion which affect the pay/pension of future pensioners shall also be passed on to the past pensioners from the same date [Para 10].

  • For implementation of OROP based on the existing norms viz. Rank, Pay drawn, Qualifying service etc, following two options are proposed



  • Option I           On the basis of average/mean amount of pension for all current retirees



  • Option II          On allowing notional increments on minimum of fitment tables for the rank last held

  • Pension differs for the same rank and the same qualifying service due to different pay drawn by each individual



  • To neutralise the difference, an average (arithmetic mean) of pension of all current pensioners (post 2006) could be determined and applied to past pensioners



  • Protection for pst-2006 pension drawing less than the mean shall be required



  • Those drawing pension above the mean continue to get the higher amount of pension

  • Service rendered in the rank held last shall be considered



  • Minimum of fitment tables for the rank last held to be taken as a benchmark on 1.1.2006



  • The increments earned during the service in the last rank held shall be notionally allowed @ 3% over the minimum of fitment tables



  • 50% of the amount so fixed could be considered as pension

Dear Colleagues,
          A falsehood is being spread that since Army Commanders and other Lt Generals are already getting OROP, they are not taking interest in pursuing OROP. Let me give the correct picture.
1.    Army Commanders.  The Army Commanders were on a fixed scale of pay of Rs 80,000/- (and thus a pension of Rs 40,000/-) till 7th Pay Commission. However, with implementation of the 7th Pay Commission from 1/1/2016 onwards, their pension was multiplied by 2.57 and their basic pension thus came to Rs 1,02,800 (40000X2.57). However, the post Seventh PC Army Commander are getting a higher basic pension of Rs 1,12,500/-. This anomaly was brought to my notice by my old Army Commander Lt Gen RM Vohra, MVC. On my checking, the Army authorities, confirmed this difference and said a case has been projected to the govt for resolution.

2.    Lt Generals.      The Lt Generals NEVER had OROP. Nor are they getting it now. Prior to 1/7/2014, the pre-1/1/2006 Lt Generals were getting a basic pension of Rs 36,500/- while post 1/1/2006 retirees were getting 39,500/-. After implementation of Seventh PC report also there is a difference. As on date all Lt Generals that had commanded a Corps and retired after 1/1/2016 are getting pension based on HAG+ pay scale whereas the earlier retirees as Corps Commanders are not getting it. There is therefore, no question of Lt Generals ever having got OROP.

The myth is being deliberately propagated by someone not holding the rank of Lt General and trying to mislead everyone by projecting himself as a Messiah of junior ranks. The sad fact today is that a handful of agitators have tarnished the image of the entire veterans’ community.

Dear General,
The correct position as available from GoI documents is given in subsequent paragraphs. You may wish to forward to the others, if you deem it fit.
The 7th CPC proposed two options for implementation of the recommendations. Both were accepted by the Govt of India vide Resolutions 1 E and 2E dated 5.9.2016.  These were modified by Army and Air Force Pay Rules 2017 and Navy Pay Regulations 2017 dated 3.5.2017. The Pay Rules 2017 for Army and Air Force Officers and Regulations 2017 for Naval Officers were amended on 6.7.2017 by incorporating more levels of the pay matrix for officers up to the rank of Brig (and equivalent) and increasing the Index of Rationalisation (IoR) or multiplication  factor for Lt Col, Col and Brig (and equivalents) from 2.57 to 2.67.
The IoRs are - 2.57 up to Maj (and equivalents), 2.67 for Lt Col, Col, Brig (and equivalents), 2.72 for Maj Gen and Lt Gen (and equivalents) 2.81 for VCOAS and Army Cdrs (and equivalents) and 2.78 for the COAS/CNS/CAS.

The two options provided by the 7 CPC were: -
Option A - INTERIM PAY AND PENSION For Immediate Implementation: -  The 6th CPC Pay in the Pay Band (PIPB) + Grade Pay + MSP as on 31.12.2015 would be multiplied for all ranks (and civilians employees) by a IoR of 2.57 and arrears of pay and pension paid immediately.
Therefore, VCOAS/Army Cdrs (and equivalents) who were drawing Rs 40000 (half of Rs 80000/- which was their pay) had their pension multiplied by 2.57 and were paid Rs 1,02,800 as INTERIM PENSION. 

Option B - LONG TERM: -  An Empowered Committee of Secretaries (ECOS) would examine the proposal of notional pay as on date of retirement/death earned through the 4, 5, and 6 CPC, as applicable. This was recommended by the ECOS in May 2017 and approved by the Govt in May 2017.

 MoF has issued through Dept of Pension & Pensioners Welfare for Civilians on 6.7.2017) determining the pension.

The Concordance Tables are based on the existing formulae for transition from pay commission to pay commission. They are as follows: -
From 4th to 5th CPC: Total of Pay + Rank Pay + Stagnation increments + DA as on 31.12.1995 multiplied by 40% and added to derive 5th CPC Pay
From 5th to 6th CPC: Total of Pay + Rank Pay + Stagnation increment + DA + Dearness Pay (50% of Pay) as on 31.12.2005 multiplied by 1.86 (erroneously mentioned as 1.84 in the email) to derive 6th CPC Pay  

From 6th to 7th CPC: Total of Pay in Pay Band + Grade Pay + MSP + DA as on 21.12.2015 multiplied by 2.57 and placed in the Pay matrix at the next higher level.

Pensions in 7th CPC

Therefore, the Notional Pay for VCOAS/Army Cdr (and equivalent) being Rs 9000 in 4 CPC, Rs 26000 in 5 CPC and Rs 80000 in the 6 CPC, their pensions are fixed as 50% of the VCOAS/Army Cdr (and equivalents) as on 1.1.2016. The pay of VCOAS/Army Cdr (and equivalents) as on 1.1.2016  is Rs 2,25, 000 (Rupees two lakh tenty five thousand). Therefore, the pension of VCOAS/Army Cdr (and equivalents) is fixed as Rs 1,12,500.      
The PCDA (Navy) and JCDA (Air Force) have issued several new PPOs for retired CNS, VCNS/FOC-in-C and CAS, VCAS/AOC-in-C (my e-PPO was attached for ready reference of Lt Gen Kadyan but deleted here).
Pensions for Lt Gen (and equivalents and below) await approval of the Concordance tables prepared by O/o CGDA, which are undergoing vetting by the MoD (Def/Fin)

Further, Lt Gen (and equivalent) progressed from HAG to HAG+ On Non-Functional Basis subject to a maximum of not more than one third who could not be appointed Army Cdr (and equivalent) because they did not have residual service. It is not just Corp Cdrs . You may wish to read Para 4 (ii) of the SAI 2/S/2008 (reproduced here but not in the reply to Lt Gen Kadyan) "Lieutenant Generals who are fit for promotion as Army Commanders, but overlooked due to lack of residual service of two years will be granted scale of Army Commanders (Rs 80000-fixed) on a non-functional basis. AHQ in consultation with Ministry of Defence will issue detailed guidelines to be followed for granting such non-functional upgradation."

Grievance Description:Honourable Prime Minister, After your promise at the Ex-Servicemen (ESM) Rally in Rewari in September 2013, every ESM and family pensioner extended wholehearted support to the honourable Prime Minister. You then promised One Rank One Pension (OROP) on three Diwalis (2014, 2015, and 2017) while addressing serving Other Ranks and Officers of the Armed Forces in Siachen and other Forward areas. Presently about 18 lakh pre 2013 Defence Forces retirees and family pensioners await the approval and announcement on the Govt’s decision on the recommendations of the Judicial Committee submitted in November 2016. 2. The honourable PM must be aware that instead of One Rank One Pension, there are One Rank Several Pensions viz. the maximum pension, the in between maximum and average pensions (all protected) and average pensions for the same rank and same length of service because the batches (Courses) are large. For example, in a batch of 60 Colonels with 28 years of service, some may be getting Rs 50000 (maximum), some others Rs 45000, yet some others Rs 40000 or even Rs 37500 whereas the average pension of all Colonels (non AMC/ADC/RVC) with 28 years of service might be Rs 36500. 3. This is very different from the Non-Functional Financial Upgradation (NFU) that the bureaucrats continue to be rewarded with. The bureaucrats of every batch get the higher pay by one increment and higher Grade Pay and continue to do so. The batch does not have maximum pay, pay in between maximum and average pay. 4. The honourable PM must be aware that the MoD keeps seeking and getting extensions from the Committee of Assurances of the Lok Sabha every three months on the plea that the Report is being examined. The honourable PM must be apprised of this situation lest some other misguided elements decide to initiate another OROP agitation demanding payment of pension even if from remote Ram Lila grounds. If that happens, then the repeated statements of the honourable PM that he extends his all-out support for Armed Forces and welfare of widows of martyrs and ESM will, to quote Shri Harish Khare, “stand depleted of all nobility and goodness.” 5. Therefore, the honourable PM may wish to examine the Report and take remedial actions by publishing the recommendations and (a) accepting or (b) rejecting the Report so family pensioners and pensioners know the finality of decision on OROP before the Model Code of Conduct takes effect in 2019 – almost 3 years from the date that Justice Reddy submitted his report on One Rank One Pension. A.         GoI, MoD No 17(4)/2008(1)/D(Pen/Policy) dated 11.11.2008



“4. Consolidation of Pension



4.1. The Pension/Family Pension of existing Pre-1.1.2006 pensioners/family pensioners will be consolidated with effect from 1.1.2006 by adding together:



(i)         The Existing Pension (including commuted portion of pension, if any)/ Existing Family Pension.



(ii)        Dearness Pension, if any, as applicable from 1.4.2004 to those retired /died prior to 1.4.2004.



(iii)       Dearness Relief upto AI CPI (IW) 536 i.e. 24% of basic pension/family pension plus dearness pension.

                       

(iv)       Fitment weightage @ 40% of the Existing Pension/Existing Family Pension. Where the amount of fitment weightage work s out in fraction of a rupee, it will be rounded off to the next higher rupee.



NOTE:  Where the Existing Pension/Existing Family Pension includes the effect of merger of 50% of Dearness Pay in respect of those retired/died on or after 1.4.2004, the existing pension/family pension for the purpose of fitment weightage will be re-calculated after excluding the merged Dearness Pay of 50% from emoluments for computation of existing pension/existing family pension. This will be in line with the definition of “Existing Pension” and “Existing Family Pension” given in Para 3 of these orders.



4.2.      The amount so arrived at in terms of Para 4.1 above will be regarded as consolidated pension/family pension with effect from 1.1.2006. Since the consolidated pension will be inclusive of commuted portion of pension, if any, the amount of pension commuted will be deducted from the said amount while making monthly disbursements.



5. The consolidation of pension will further be subject to the provision that the consolidated pension, in no case shall be lower than fifty percent of the minimum of the pay in the pay band plus the grade pay corresponding to the pre revised scale from which the pensioner had retired/discharged including Military Service Pay and ‘X’ Group pay where applicable.



 For example, if a pensioner had retired in the pre-revised scale of pay of 6600 – 170 – 9320, the corresponding pay band being 9300 - 34800 and the corresponding grade pay and Military Service Pay being Rs. 4,600/- and Rs. 2,000/- respectively, his minimum guaranteed pension would be 50% of Rs. 9300 + Rs 4600 + 2000 i.e. Rs 7,950 for 33 years of qualifying service. The pension so calculated will be reduced pro-rata, where the pensioner had less than the maximum required service of 33 years for full pension and in no case it will be less than Rs. 3,500/-. In case the pension consolidated as per Para 4.1 above is higher than the pension calculated in the manner indicated above, the same (higher consolidated pension) will be treated as Basic Pension with effect from 1.1.2006.



B.         MoD, vide No. 12 (1)/2014/D (Pen/Policy) – Part II dated 3.2.2016 has stated as follows:



6….. If revised pension as on 1.7.2014 worked out in terms of these orders happens to be less than the existing pension/family pension as on 1.7.2014, the pension shall not be revised to the disadvantage of the pensioner.



            10. The OROP shall be basic pension from 1.7.2014…..”



C.         GOI, MOD letter No. 1(2)/2016 - D(Pen/Pol) dated 30th September 2016

         

4…… Therefore, it has been decided that w.e.f. 1.1.2006 revised consolidated pension and family pension of pre-2006 armed forces pensioners shall not be lower than 50% and 30% respectively of the minimum of the pay in the Pay Band plus Grade Pay corresponding to the pre-revised scale from which the pensioner had retired/discharged/invalided out/died including Military Service Pay and Group X pay, if any, without pro-rata reduction of pension even if they had rendered qualifying service of less than 33 years  at the time of retirement. Accordingly, Para 5 of this Ministry’s letter dated 11.11.2008 would stand modified to this extent.”



D.         The Govt of India (and MoD) has approved (GoI, MoD letter No. 17 (01)/2016-D (Pen/Pol) dated 29th October 2016) that pension in the 7th CPC dispensation would be based on notional pay on the date of retirement/death. The exact wordings are as follows:



It was provided in the ibid Govt letter (GoI, MoD letter No. 17 (01)/2016-D (Pen/Pol) dated 29th October 2016. It was provided in the ibid Govt letter that the revised pension/family pension w.e.f. 1.1.2016 of pre-2016 pensioners/family pensioners shall be determined by multiplying the Basic Pension (before commutation/Basic Family Pension (exclusive of Dearness Relief) as has been drawn on 31.12.2015 by 2.57 to arrive at revised pension under 7th CPC.



3. Revised pension/family pension of all Armed Forces Personnel who retired/died prior to 01.01.2016 shall be revised by notionally fixing their pay in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which they retired/died. This will be done by notional pay fixation under each intervening Pay Commission based on the formula for revision of pay. The revised rates of Military Service Pay, Non-Practising Allowance, where applicable and ‘X’ Group pay & Classification Allowance for  JCOs/ORs, if applicable notified in terms of 7th CPC orders, shall also be added to the amount of pay notionally arrived at under the 7th CPC matrix and shall be termed as notional reckonable emoluments as on 01.01.2016….”             



E: Some back of the envelope figures



Minimum Notional Pay of Lt Col viz. PIPB Rs 37400 + GP 8000 + MSP 6000 = Rs 51400 and pension Rs 25700 in the 13th year of service.



With an annual increment of 3%, the Lt Col’s Notional Pay works out to Rs 55840 + 6000 = Rs 61840. Pension would therefore be Rs 30920 (rounded off to nearest Rs 10/-). 



However, Table 1 of Circular 555 shows the pension of Lt Col at 20 years service as Rs 31305 i.e. the Notional Pay is Rs 62610.  



But Annexure A of Circular 568 shows minimum Notional Pay for Lt Col (TS) as Rs 52530 and pension as Rs 26265.
