To Query Whether RDOA has worked out entitlements

3.       Accordingly, consolidated modalities modifying the existing SAIs/SNIs/SAFIs to the extent specified hereunder are being promulgated for the implementation of the ibid Court order.

Section-I : Modifications effective from 01 January 1986 to 31 December 1995 (SAI/SNI/SAFI 1/S/87)

4.       As the judgment is applicable to all officers upto the rank of Brigadier & equivalent the pay scale mentioned at Para 3 of SAI/SNI/SAFI 2/S/87 stands amended.  The following revised integrated scale will be admissible to officers of the rank of 2nd Lt to Brigadier and equivalents wef 01 Jan 1986.

5.       On 01 January 1986 the pay of all officers will be fixed again in the integrated pay scale in the following manner:-

(a)      For the purpose of re-fixation the pay drawn by an officer on 01.01.86 in the existing scale of 3rd CPC will be considered.  The pay such drawn will be enhanced by the following fixation formula to arrive at the revised pay: -

(i)      An amount representing 20% of the basic pay in the scale drawn by officer on 01.01.86 shall be added to the “existing emoluments” of the officer.

(ii)     Thereafter, the officer’s pay will be re-fixed, without deducting the rank pay as was done earlier, in the integrated scale at para 4 above, at the stage next above the amount thus computed.

(iii)    In case the stage of fixation falls below the minimum pay for the rank held by the officer on 01 Jan 86 as prescribed in the table below, the pay will be stepped up to such minimum provided the officer has completed the length of reckonable commissioned service indicated in the same table.

(b)     Rank Pay.   In addition to the re-fixed pay in the integrated pay scales, the following Rank Pay shall be paid depending on the rank held :-

(c)      The above stated pay scales shall be used for re-fixation of all officers who were in service on 01.01.86 and also those who came into service after that date.

          (d)     If the pay of an officer in the integrated scale on the date following the completion of the length of service indicated in the table at sub Para 4 (a) (iii) above is lower than the minimum pay for the rank held, as given in the same table, his pay will be stepped up to such minimum with effect from such date.

          (e)      Similarly in the case of an officer who, is promoted to the next higher rank after 01 Jan 1986, is in receipt of pay in the integrated scale which is less than the minimum pay prescribed in the table at sub Para 4 (a) (iii) above, the pay from the date of promotion shall be reckoned to be the minimum for that rank as shown, provided that he had completed the length of service indicated in the same table.

          (f)      From the date of promotion to the next higher rank, whether in a substantive or acting paid capacity, the officer will draw the rank pay appropriate to the rank to which he is promoted, in addition to the pay in the integrated scale.

Section-II : Modifications effective from 01 January 1996 to 31 December 2005

6.       The following changes are made to the SAI/SNI/SAFI 2/S/98 :-

(a)      The revised regular pay scales will be admissible to officers of the rank of Lt and equivalents to Brigadier and equivalents from 01 Jan 1996.

7.       The pay scales at Para 6 above, shall be used for re-fixation of pay for all officers who were in service on 1.1.96 and also those who came into service after that date.

Fixation of Initial Pay in the Revised Scales

8.       The fixation of initial pay will be regulated as under:-

(a)      An amount representing 40% of the basic pay including stagnation increments, if any, and rank pay whenever applicable in the pre-revised scale, shall be added to the “existing emoluments” of the officer.

(b)     Thereafter, without deducting the amount equivalent to the rank pay, if any, the officers pay will be fixed in the revised scale at the stage next above the amount thus computed according Para 8 (a) above.

(c)      If the amount so computed as at Para 8 (a) above is more than the maximum of the revised scale, the pay will be fixed at the maximum of the revised scale.

(d)     If the Minimum of the revised scale is more than the amount so computed as at Sub Para 8 (a) above, the pay will be fixed at the minimum of the revised scale.

(e)      For computation of bunching increments, the first stage in the existing scale shall be w.r.t the minimum pay prescribed for each rank as given below:-

(f)      Provided also that the fixation thus made shall ensure that every officer will get one increment in the revised scale of pay for every three increments (inclusive of stagnation increment (s) if any) in the existing scale of pay.

  1. Sir, newer readers, and older ones who may have forgotten, need to know this valuable information was made available by you in 2013 through your RTI campaign as enclosure 23B of this blog post.

    If RDOA contentions and the TRIPAS DGL "recommendations" have commonality, as they would, being based on the true arrears actually due, then two things straightway appear to strike a reader, subject to corrections and amplification from you, of course :

    (a) There is a revision of pay-scales due without which true rank pay has not been paid in full in instalments 1 and 2 of rank pay arrears.

    (b) There is a re-fixation of initial pay stage for each rank without which, again, the rank pay arrear payments fall short of the "letter and spirit".

    There are other inferences, such as the total absence of distinction in rank pay for select and time-scale ranks.

    But how the litigation will be proceeded with is, of course, going to be as per the best judgement of the legal team. We can but wait for further enlightenment from this blog as the matter progresses.

  2. Dear Sir,
    Thanks a ton for brushing up everyone's memory in the New Year. A small query from my side, may not make sense but I could not help ask you this. In one of the exchange of notes obtained through RTI by you, based on a specific query from one Dy Secy from MoF (DoE), he had brought out that the RP had been deducted twice not once as perceived all these years. Towards this the Dy Secy had brought out the correct implementation of Capt and equi payscale as Rs.10,300/- wef 01 Jan 96 instead of Rs.10,000/- as we all have understood and the same has been reflected even in the DGL submitted by the Services HQ (reproduced in the above post). I will try and dig out the older post and put it up in a day or two for everyone's understanding!
    A small observation on the last hearing. When the HSC had accepted the Contempt Petition (Civil) it is indicative that implementation in true spirit of the judgement by the MoD is found wanting. After all these postponements and after a year Addl SG tells the Court on the day of hearing that he wants 3 weeks time for filing a status report is not understood. As one who do not have any legal knowledge, like the majority of the followers of this blog, as far as MoD is concerned they have already completed the implementation as per their interpretation, barring few cases of missing data and post AG's opinion.
    Please do make us understand the ground reality. Next date of hearing is tentatively fixed as Friday the 13th (Feb 15). Let us all wait and see if that is really auspicious for all non-believers! Once again please keep up your pace with the RTI weapon in your hand! Jai Hind!

  3. Sir,
    Pay scale of Majors/equivalents has been shown as 13125-375-16550 vide para 6. However, the scale has been shown as 12800-375-16550 vide para 9. I think that it should be 13125 in view of MoD letter No. I(26)/II/D(Pay/ Services) dated 29 Feb 2000 which states - "that the issues regarding certain anomalies arising from the implementation of revised pay scales and allowances consequent to Fifth CPC award for the Defence Services personnel has since been considered by the Government in the light of the recommendations of a Committee specially constituted on the above subject and it has been decided that the pay of officers of three services on promotion to the rank of Major and equivalent in substantive capacity will be fixed initially at the stage of Rs. 11925/- in the pay scale of Rs. 11600-325-14850, in addition to rank pay.”
    In addition, 5cpc pay scales were finalized based on 4cpc pay scales and Rank Pay was doubled by 5cpc. For example 5cpc pay scale of Majors (11600-325-16550) was finalized based on 4cpc pay of 3400 (3400x3.41=11594) and Rank Pay was doubled from 600 to 1200. If 4cpc pay is raised from 3400 to 4050 and we apply the same multiplication factor of 3.41, 5cpc starting pay scales works out to 13810 (4050x3.41) in addition to Rank Pay of 1200 and Majors will move to PB-4 in 6cpc. I am of the opinion that it is a question of (a) adding rank pay amount to 4cpc pay scales (b) revision of 5cpc pay scales and (c) its impact on 6cpc. It should not be treated merely adding the rank pay amount to existing 5cpc scales

    Para 6 states what the pay-scale will be (as per provisions of the DGL) for the period 01 Jan 96 to 31 Dec 2005. Para 9 states what the actual pay-scales are for that period.

    Where is the mistake there? I see none.

      Para 9 is under "Section-III- Modifications effective wef 01 Jan 2006". I think the subject is quite clear and para 9 contains the figures which will be applicable wef 01 Jan 06 under 6cpc.

      Please pardon my ignorance.
      If the annual increment for a Major is Rs.375/- in the V CPC Regime, should the scale for Major at Para 6. above, not start at 13175/- instead of 13125??
      Also at Para 9, it appears to me that the Scale for Major starting at Rs.12800/- is correct;except for the fact that post 2004, AVSC -I, there are no acting Majors .Therefore a Note should be inserted at the end of the Table at Para 9., that all Substantive Majors start at Rs. 13175/- instead of Rs.12800/-.

      Existing rate of increment for Majors is 325 and the figure of 13125 has been shown based on MoD letter dated 29 Feb 2000. Revised rate of increment @ 375 will be applicable on revision of pay scale.
      Acting Majors were getting pay scale of Capts and Rank Pay of Majors under 5cpc. Pay scale of Majors was applicable only to subs Majors. Since 5cpc pay scale already stands revised to 13125, 6cpc pay should be fixed based on 13125 and not on 12800.

      It should have been clear but it seems it is still being struggled with in the minds of some.

      All those paras are part of a DGL that was not implemented but will be if RDOA insist on its implementation as part of their contempt petition.

      Those paras are not the ones that were implemented by VI CPC. But they will be if the DGL is accepted as basis of judgment in contempt petition.

      This is what the entire blog post is about viz., RDOA having worked out entitlements, yet we have a steady stream of comments about tables and columns without even understanding the context which ought to be clear first of all.

      Starting 5cpc pay scale of Majors was revised to 11925 so as to remove the anomalies of 5cpc by MoD. I want to submit that 6cpc pay should be fixed based on this figure (11925+1200=13125). If my contention is correct, all should keep this in mind.

      You are mentioning the figure of 11925/-. The existing pre-revised scale for Maj is listed at para 9 as 12800-375-16550. Either you are confusing the specified scales with fixations or your information is not correct.

      Sir,
      I get your point. The figure in column 3 Row 3 of Para 9.too should have been 13125 instead of 12800 since the GoI themselves have revised the starting of Maj. Scale to 11925, in Year 2000.
      Even the 6 CPC did not correct the starting pay of Maj( in VCPC) to 11925.
      All of us are aware that these tables presented in this blog post are 'proposals' of RDOA and Service HQ.Even in the proposals, the assumptions, that is the Scales of VCPC should be correctly represented, taking all amendments upto VI CPC, into account.

      Majors were placed in 5cpc pay scale of 11600-325-14850 plus a Rank Pay of 1200. Subsequently the starting point was raised to 11925 so as to remove the anomalies of 5cpc, vide MoD letter dated 29 Feb 2000.
      The likely scale has been shown as 13125-375-16550 in para 6 and 12800-375-16550 in para 9 of DGL which may take place after finalization of Rank Pay legal case. Please refer the above post.
      I am trying to submit that it should be the same in both the para (6 and 9) and the figure should be 13125-375-16550. I hope I am clear.

      Who says column 3 of table at para 9 is, as you've called it, the "likely scale"?

      Does the column heading not say Existing?.

      @penmil: All of us are aware
      That does not seem to be the case here.

      The "existing" details in the DGL are "existing". Why are there any doubts about it?

      Which letter has amended the "existing" scale of Maj as shown at para 9? Was a new Maj scale (pre-revised) ever notified?

      Where is the merit in confusing starting pay fixation etc with the official "existing" scale. The fact is, there is no "point" that one can "get" in this pointless, off topic discussion.

      The above is the existing scale. I have drawn the above scale during the currency of 5cpc. Please update yourself.

      The issue is very simple. The DGL states at para 9, Ser No. 3, Col 3 that the "Existing" Pay scale for Major is 12800-375-16550. If the scale 13125-375-16550 has not been notified, and para 6(a) DGL actually seeks this should be the scale, then where is the error in the table?

      It says 12800-375-16550 is the pre-revised scale (existing) and 15600-39100 + Rs 7600 + Rs 6000 should be the revised one.

      Till the scale 13125-375-16550, recommended at para 6(a), is also implemented as the V CPC scale, how can it be included as "existing" pre-revised scale? Now, if the scale 13125-375-16550 had already been notified, then you should provide a reference or copy or link. Did the letter referred by you, as you have not given a link or a reference, say the scale for Maj was such and such or from this to this? Fixing the starting point within an existing scale may be different from an actual scale.

      5cpc pay scale for Capts to Brigs are as under as given in SAI 2/S/1998:
      Capt - 9600-300-11400 (plus RP of 400), Major - 11600 (11925)-325-14850 (plus RP fo 1200), Lt Col - 13500-400-17100 (plus RP of 1600), Col - 15100-450-17350 (plus RP of 2000), Brig - 16700-450-18050 (plus RP of 2400).
      The above pay scales were applicable during the currency of 5cpc. Please compare the above pay scales what you term as "existing scale".

      What you have pointed out is 100% correct.
      Atleast Services HQ DGL (we cannot imagine CGDA doing it ofcourse) should have incorporated this change in scale showing higher EXISTING basic pay for Majs for 5th CPC.

      What you saying is correct in view of change in the pay band after the anomaly was rectified. But I don't think it was implemented for all. I continued to get the old scale (i.e starting with Rs 11600) when I became a maj during the 5th CPC and I don't think I got any arrears or my scale was revised. If it was implemented for others then one would have got to know of this in the unit. Thus, there is a strong possibility that CDA just kept the govt decision in cold storage and did not implement it. In fact on picking up the rank of Lt Col also the old slab of Rs 11600 was used in fixing the pay of Lt Col select grade.

      It is slightly humiliating to own up that was taken for a ride by the CDA but sharing it on this blog so that others in similar situation should take this into account when the arrears for them are calculated by CDA.

      Incidentally, I am yet to receive any arrears from CDA although I was a Capt with eight yrs service.

      It is the DGL table that terms it as "existing", not me.

      The scale you quote viz., 11600(11925)-325-14850 is lower than the scale 12800-375-16550 shown as pre-revised existing in the table at para 9.

      As per para 6, the revised V CPC scale should be 13125-375-16550. But it won't be the V CPC revised scale till the DGL is implemented, so the table at para 9 must reflect the existing reality, must it not? Even with the 13125-375-16550 scale, the revised payband would be 15600-39100, would it not, as shown?

      The fixation, over which there seems to be so much perturbation, is given in table at para 10 not in paras 6 or 9 which you have been referring to. For a un-revised basic of 13175/- the revised basic for fixation is shown as 26740/- at para 10.

      Now tell me what is your calculation for fixation of revised basic (post 01 Jan 2006) for existing basic (pre 01 jan 2006) of 13175/- so that we can accept your contention the tables are wrong.

It is learnt that this aspect has since drawn the attention of Services HQ and will be reflected in the next DGL after finalization of Rank Pay Contempt Petition.

That is what I've been trying to submit all along viz., the DGL table as shown reflects existing reality. After the contempt petition judgement, whatever scales are finalised would find a place in tables of GOI letter for implementing the judgement. The DGL could only have stated what had been perceived to be the present unrevised scale.

      My stress has been relation to the observation " has been shown as 12800-375-16550 vide para 9. I think that it should be 13125" in the comment dated 12th. It should be but isn't till the 13125 scale is officially accepted. So not having 13125 as unrevised scale in the DGL table is not an error or mistake as per my perception.

      Your initial comments on 12th Jan make everything very plain.
      The bottom of the scale for Majors got revised upwards to 11925 ( from then existing 11600) by that MoD Letter of 29 Feb 2000. Even though this changed bottom may not have been notified by revising/ amending SAI, change did occur (due to the Govt Letter). So unquestionably the scale got automatically changed to 11925-325-14850.
      The DGL should reflect this change.
      But since you have clarified that this change will be reflected in the next DGL as Services HQ have acknowledged, the matter ends for me. :)

After seeing RM's interview on 12/01/2015 where he again talks about 80 % satisfaction though i feel he is actually talking about 80% pension & his concern for civilians asking for OROP,i feel the Rank pay case assumes even more importance.For all we know what we get out of Rank pay case as per the tables shown above may work out to be more than what may be announced for OROP
    How ever i can certainly say that the arrears what i got out of second installment is no where near the tables shown above & neither CDA is giving the details

    The sequence seems straightforward:

    Pensions will go up due to enhancement in Last Pay Drawn as a result of :

    (a)Instalments 1&2 of Rank Pay arrears.

    (b)Arrears resulting, hopefully, from contempt petition in accordance with tables given in this blog post.

    OROP is for all ESM, not just for retired officers affected by the Rank Pay matter. For retired officers, the "One Pension" of OROP will have to be based on the higher pensions resulting from Rank Pay arrears. OROP comes after all these Rank Pay increases have been factored into existing pensions.

    We should now wait and watch how pension tables are revised after the first two instalments of Rank Pay arrears and then after the judgement on the contempt petition. Interactions with CDA should be focused on getting fresh PPOs issued on basis of increases in last pay drawn and for revision of pension tables issued by VI CPC.

    I had tried to say something on those lines in this comment.

      I am aware OROP is for all ranks & not just officers.If one compares the DGL of OROP & the above tables the difference is not much for various Officer ranks
      While we want that every thing should be sequential & progressive, the utterances of RM and others are not progressive.They are rather digressive & we should be prepared for that
      MY only doubt is whether CDA has paid as per these tables or they are again using some other method.Does any one knows whether the AI have been revised or not?

      How will CDA pay as per these tables until and unless they are ordered to comply with a, hopefully, favourable judgement of HSC telling them to pay as per these tables.

      They have paid instalments 1&2 of rank pay arrears as per provisions of MOD letters that I had even provided a link to in that comment.

      Where is the "DGL of OROP"? Could you provide a link so everyone can understand what your doubt is?

      Under OROP all previous pensioners will draw pension equivalent to pension of someone with equal service and in the same rank on a yet to be agreed on cut-off date. How can these tables define that?

      This "progressive/digressive" debate can carry on, of course, but let us first ourselves be clear about what the issues are.

  9. I am recording my initial reactions to the proposed amendment to SAIs. I am not sure whether I am right. I am seeing it from the point of view of a non-med Capt in 1986 and Maj in 1989.

    In para 6 Lt rank may be added and Rank pay shown as Nil
    In para 8 then applicable DA, IR I and IR ii should also be added
    In para 9 (3) Maj should move to PB 4 with a higher grade pay than 7600
    In para 10 fixation of initial pay in the revised pay structure in respect of Maj will change suitably.

    If pay arrears and pension arrears are paid with interest i may think of forgiving the culprits who perpetrated the tyrannical orders with no regard for justice, fairplay, equity or basic common sense and logic. No 100 or 80% satisfaction!

      Luckily, this matter, viz., rank pay arrears, is not subject anymore to the views and whims of %age adjusters, being in HSC.

      It is absolutely correct of you to suggest that all arrears should have been paid with interest from the date due and not wef 01 Jan 2006.

      Given the downright questionable machinations and tactics, employed by sections of the Govt, that illegally sought to deny due entitlements over such a long period, leading finally to a contempt petition now awaiting a hearing, it would not be out of place to not only obtain full justice in the shape of full implementation of provisos of the DGL but also payment of penal interest, or DSOPF rate of interest compounded annually, on each arrear as counted from the date the arrear arose, 31 Jan 1986, 28 Feb 1986 and so on.

    2. I know satisfaction % is an innovative invention of the present RM in another context. To quell the fury of unsuspecting veterans, RM should dig deep to find out who were / are responsible for the denial of justice and delay and sort them out right and proper. They have made a mockery of the system. MOD and GOI look like a absurd theatre with jokers and clowns masquerading as wise counsels The pity is that they don't grow up and realize how much eggs they have on their ugly faces.

    After having gone through recapitulation, I feel CDA(O) Pune is wrong when it is stating the following as its response to 4th CPC anomaly. I humbly seek your valuable response and confirmation to make us wise on each of these four aspects :-

    (a) In respect of an officer who was commissioned as 2Lt in Dec 1987 (with basic as Rs 2300/-) and became substantive Capt in Dec 1992, there has been no deduction of rank pay since the anomaly exists wrt the pay fixation formula only in respect of those offrs who were Capt as on 1/1/86 and which has been corrected by non deducting rank pay from their pre-revised emoluments.

    (b) The officers holding the rank of Capt to Brig as on 1/1/1986 are only affected by HSC verdict dated 4/9/12 for pay revision, coupled with MoD letters of 27/12/12 and 24/7/14.

    (c) The formula of non deduction of rk pay for pay revision wef 1/1/86 is not applicable for offrs promoted to rk of Capt after 1/1/86 since their pay was fixed to minimum pay for rk of Capt ie Rs 2800/-.

    (d) After issue of amendment letter dated 24/7/14 by MoD, revision of 5th CPC is only to be carried out wef 1/1/96 for all offrs who were promoted to the rk of Capt after 1/1/86 and were in service as on 1/1/96.
