RTI dated 06 Jan 14 – Action taken by MoD on Ld AG’s opinion dated 03 Sep 13

* Description of Information Sought

Learned Attorney General for India provided opinion dated 3.9.2013 that the Order of the Honourable Supreme Court in IA No. 9 of 2010 in TP (Civil) No. 56 of 2007 in UoI Vs Lt Col N K Nair & Others is applicable to 4th, 5th and 6th Central Pay Commission.

2. Please provide information such as notes on file, deliberations, discussions, and related information as detailed in Section 2 (f) of the RTI Act 2005 on the actions taken by MoD (D-Pay/Services) subsequent to receipt of the opinion of the Ld Attorney General.

3. Please provide a date-line for completion of implementing the same as many similarly situated officers have to provide for payment of income tax for this FY 2013-14 and pay advance tax by or before 15 March 2014, as per provisions of the Income Tax Act.

Reference is invited to Ministry of Defence ID No. MODEF/R/2014/(60037)D(RTI) dated 7.1.2014 (received in this section on 8.1.2014  forwarding your application dated 6.1.2014 on the above subject.

2.         Regarding information sought vide Para 2 of your application, it is stated that the concerned file has been sent to LA (Defence) on 3.1.2014 to place it before Ld Attorney General for seeking his second legal opinion on the issues raised by Chairman COSC and CAS.

3.         Regarding information sought vide Para 3 of your application, it is stated that no date line has been fixed.
