Here is an response from the writer:
"The Defence Ministry has in a high-level meeting with the Finance Ministry recently raised the bill for the implementation of the One Rank One Pension scheme. The Finance Ministry gives the money to the Defence Ministry for the implementation. The actual disbursement of the money comes under the Defence Ministry. The story doesn't say that the money has been disbursed to pensioners. It says that the bill for the payments has been raised with the Finance Ministry. 

Guess the reader can be reassured that now that the money has been claimed by the Defence Ministry it will be disbursed too soon i hope."

Sir,

          Please provide information on file notings etc on action taken for compliance with orders of the Honourable Prime Minister and the Honourable Raksha Mantri as well as the assurances to the Respected Parliament made by the Honourable RM and Honourable  RRM on One Rank One Pension.

2.       Information is as described in Section 2 (f) of the RTI Act, 2005 i.e. information means any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force.

3.       Sections 8, 9 or 10 of the RTI Act, 2005 may also be referred while processing this request for information.


4.       Requirement to be physically present in MoD to search for and point out the information required may be exempted unless the information that is sought to be provided will far exceed the cost of travel from and return to Bangalore as well as other expenses.

5.       Please intimate the additional amount to be deposited @ Rs 2 per photocopied page of information.

Sir,

I am aggrieved by the response of the CPIO dated 8.10.2014 (attached as supporting document) in response to my request dated 21.9.2014 that information cannot be provided because the file is under submission. This is not one of the grounds for not providing information under Section 7 of the RTI Act, 2005.

I therefore request that the information be provided or a categorical refusal and the grounds vide Section 7 (8) thereof be provided to me within the time frame provided by the RTI Act, 2005.

It appears that CPIO is disposing off my request for information summarily stating the file is under submission is contravening Section 18 Sub-sections (b), (c), (e) and (f).
